The “PROVENZA” Case by Karol G: What You Should Know Before Registering Your Trademark

Trademark registration may seem like a simple process, but the truth is that many names can face unexpected legal obstacles.

A recent and high-profile example is that of Karol G, who tried to register the trademark “PROVENZA” in Colombia but ran into a major issue: her application was denied.

If you’re thinking about registering your own brand, this case holds key lessons that can save you time, money, and headaches. Let’s break it down simply.

Why was Karol G’s trademark application for “PROVENZA” denied?

The Superintendency of Industry and Commerce (SIC) of Colombia denied the registration of the name “PROVENZA” in three categories:

  • Class 30: Food products and seasonings
  • Class 41: Entertainment services
  • Class 43: Restaurants and lodging services

The problem arose when the Institut National de l’Origine et de la Qualité (INAO) from France filed a formal opposition. Why? Because “Provenza” is not only the name of a Karol G song—it’s also the name of a well-known French region famous for its cuisine and products protected by designation of origin.

💡 Example: If you see a brand called “Champagne” on a soda bottle in Colombia, you’d probably think it has something to do with France. That’s what happened with “Provenza.”

According to the SIC, registering this name could:

1️⃣ Confuse consumers into thinking the products come from the French region.
2️⃣ Unfairly benefit from the reputation of protected products, such as “Côtes de Provence” wines or “Huile d’Olive de Haute-Provence” olive oil.
3️⃣ Conflict with other trademarks already registered in Colombia.

For these reasons, the SIC rejected the application. However, Karol G’s legal team has appealed the decision, and the case is still under review.

What can we learn from this case?

This case offers several lessons for any entrepreneur, business owner, or artist looking to protect their brand and avoid legal setbacks.

🔹 1. Don’t assume you can use any name
It’s common to think that if a name isn’t registered as a trademark in Colombia, you’re free to use it. But factors like designations of origin, protected foreign trademarks, and generic names can still lead to rejection.

🔹 2. Your company and your brand are NOT the same
Many people believe that registering their company name with the Chamber of Commerce automatically protects it. But a business name (legal entity name) and a registered trademark are completely different things.

🔹 3. Conducting a background check is key
Before spending money on a trademark application, it’s essential to conduct a trademark search to identify potential risks of opposition. This can save you time and legal expenses.

🔹 4. Trademark protection gives you 10 years of exclusivity
If you successfully register your trademark, you’ll have exclusive commercial rights to it for 10 years—renewable. This prevents others from using your brand name without permission.
