If DIAN is the authority that oversees tax compliance in Colombia, the UGPP is the authority that monitors social security and parafiscal contributions. In simple terms, UGPP can review whether employers are correctly reporting and paying payroll-related contributions.<\/span><\/p><h2><b>Minimum wage and transportation allowance in 2026<\/b><\/h2><p><span style=\"font-weight: 400;\">For 2026, Colombia\u2019s monthly minimum wage is <\/span><b>COP $1,750,905<\/b><span style=\"font-weight: 400;\">, and the transportation allowance is <\/span><b>COP $249,095<\/b><span style=\"font-weight: 400;\">, for a total monthly amount of <\/span><b>COP $2,000,000<\/b><span style=\"font-weight: 400;\"> for workers entitled to the allowance. The Ministry of Labor confirmed these 2026 values through official communications related to Decrees 1469 and 1470.<\/span><\/p><p><span style=\"font-weight: 400;\">The transportation allowance generally applies to employees earning up to two monthly minimum wages. The Ministry of Labor\u2019s official labor calculator reminds employers that workers earning more than two minimum wages are not entitled to transportation allowance.<\/span><\/p><p><span style=\"font-weight: 400;\">This is important because the transportation allowance may affect the calculation of certain social benefits, such as prima and severance.<\/span><\/p><h2><b>Step 1: Define the employment contract correctly<\/b><\/h2><p><span style=\"font-weight: 400;\">Before running payroll, the company must define the type of employment contract.<\/span><\/p><p><span style=\"font-weight: 400;\">In Colombia, common employment contracts include:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indefinite-term contract<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fixed-term contract<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contract for a specific work or project<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Part-time or special arrangements, when legally applicable<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">After the 2025 labor reform, indefinite-term contracts became the general rule, and fixed-term contracts are limited to a maximum of four years. The Ministry of Labor summarized that fixed-term contracts now have a four-year limit and that indefinite-term contracts are the general rule.<\/span><\/p><p><span style=\"font-weight: 400;\">This matters for payroll because the contract type affects termination, benefits, severance, renewals, and legal risk.<\/span><\/p><p><span style=\"font-weight: 400;\">A contractor should not be treated like an employee without reviewing the real relationship. If there is subordination, fixed schedule, continuous service, and direct control, the company may face labor misclassification risks.<\/span><\/p><h2><b>Step 2: Calculate the employee\u2019s monthly salary<\/b><\/h2><p><span style=\"font-weight: 400;\">The base salary is the starting point of payroll.<\/span><\/p><p><span style=\"font-weight: 400;\">In Colombia, there is no such thing as an \u201call-inclusive salary\u201d that allows the employer to bundle every labor cost into one monthly payment. In other words, an employer cannot simply agree on a monthly amount and assume that it already includes all legal obligations.<\/span><\/p><p><span style=\"font-weight: 400;\">Every employer must assume a series of mandatory labor, social security, payroll, and benefit obligations calculated on top of, or based on, the employee\u2019s monthly salary.<\/span><\/p><p><span style=\"font-weight: 400;\">From there, the company must add or calculate:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transportation allowance, if applicable<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Overtime<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Night surcharges<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sunday or holiday surcharges<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commissions<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Bonuses<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Other salary payments<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-salary payments, if validly structured<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Not everything paid to the employee is treated the same way. Some payments may be salary, while others may be agreed as non-salary payments under Colombian labor rules.<\/span><\/p><p><span style=\"font-weight: 400;\">This classification matters because salary payments usually affect social security, benefits, severance, vacations, and payroll provisions.<\/span><\/p><h2><b>Step 3: Apply the legal working hours<\/b><\/h2><p><span style=\"font-weight: 400;\">Working time is one of the most important payroll issues in Colombia.<\/span><\/p><p><span style=\"font-weight: 400;\">Law 2101 of 2021 established the gradual reduction of the maximum weekly working hours until reaching <\/span><b>42 hours per week<\/b><span style=\"font-weight: 400;\">. The official legal text states that the maximum ordinary working day is 42 hours per week, which may be distributed by agreement between employer and worker over five or six days, always guaranteeing the mandatory rest day.<\/span><\/p><p><span style=\"font-weight: 400;\">The Ministry of Labor also explains that the reduction schedule moved from 46 hours in 2024 to 44 hours in 2025 and then toward 42 hours in 2026.<\/span><\/p><p><span style=\"font-weight: 400;\">For payroll, this means companies must review schedules, overtime, shift structures, and internal policies.<\/span><\/p><p><span style=\"font-weight: 400;\">If an employee works beyond the legal working hours, overtime or surcharges may apply.<\/span><\/p><p><span style=\"font-weight: 400;\">In Colombia, the main overtime and surcharge rates are:<\/span><\/p><table><tbody><tr><td><p><b>Concept<\/b><\/p><\/td><td><p><b>Payroll surcharge<\/b><\/p><\/td><\/tr><tr><td><p><span style=\"font-weight: 400;\">Night work<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">35% over the ordinary daytime hourly value<\/span><\/p><\/td><\/tr><tr><td><p><span style=\"font-weight: 400;\">Daytime overtime<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">25% over the ordinary daytime hourly value<\/span><\/p><\/td><\/tr><tr><td><p><span style=\"font-weight: 400;\">Night overtime<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">75% over the ordinary daytime hourly value<\/span><\/p><\/td><\/tr><tr><td><p><span style=\"font-weight: 400;\">Work on mandatory rest days or holidays<\/span><\/p><\/td><td><p><span style=\"font-weight: 400;\">80% from July 1, 2025; 90% from July 1, 2026; 100% from July 1, 2027<\/span><\/p><\/td><\/tr><\/tbody><\/table><p><span style=\"font-weight: 400;\">The Labor Code states that night work is paid with a <\/span><b>35% surcharge<\/b><span style=\"font-weight: 400;\">, daytime overtime with a <\/span><b>25% surcharge<\/b><span style=\"font-weight: 400;\">, and night overtime with a <\/span><b>75% surcharge<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">For work on mandatory rest days or holidays, Law 2466 of 2025 introduced a gradual increase: <\/span><b>80% from July 1, 2025<\/b><span style=\"font-weight: 400;\">, <\/span><b>90% from July 1, 2026<\/b><span style=\"font-weight: 400;\">, and full application of the <\/span><b>100% surcharge from July 1, 2027<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><h2><b>Step 4: Review night work, Sundays, holidays, and overtime<\/b><\/h2><p><span style=\"font-weight: 400;\">Payroll in Colombia must account for special work conditions.<\/span><\/p><p><span style=\"font-weight: 400;\">This may include:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Night work<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Extra daytime hours<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Extra night hours<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sunday work<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Holiday work<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Compensatory rest days<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Shift-based work<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Law 2466 of 2025 also modified the definition of daytime and nighttime work. As of December 25, 2025, daytime work runs from <\/span><b>6:00 a.m. to 7:00 p.m.<\/b><span style=\"font-weight: 400;\">, and nighttime work runs from <\/span><b>7:00 p.m. to 6:00 a.m.<\/b><span style=\"font-weight: 400;\"> This means that, in 2026, work performed after 7:00 p.m. may generate night surcharges when applicable.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Because several changes have gradual implementation dates, employers should review payroll rules regularly and update their internal labor regulations, schedules, and payroll formulas.<\/span><\/p><p><span style=\"font-weight: 400;\">This is especially important for companies with restaurants, hospitality, security, logistics, healthcare, retail, customer support, or operations outside regular office hours.<\/span><\/p><h2><b>Step 5: Calculate social security contributions<\/b><\/h2><p><span style=\"font-weight: 400;\">Employers in Colombia must contribute to the social security system.<\/span><\/p><p><span style=\"font-weight: 400;\">The Colombian social security system includes <\/span><b>health, pension, labor risks, and compensation fund contributions<\/b><span style=\"font-weight: 400;\">. Payment of these categories is mandatory and is distributed between the employer and the employee according to the law.<\/span><\/p><p><span style=\"font-weight: 400;\">It is not valid to agree that the employee will assume all of these costs from their salary. Even if both parties agree on a monthly compensation amount, the employer must still calculate, assume, withhold, and pay the corresponding contributions correctly.<\/span><\/p><p><span style=\"font-weight: 400;\">The percentages below are generally applied to the employee\u2019s base salary. This means that the transportation allowance is excluded, as well as certain additional payments that may be validly agreed as non-salary payments under Colombian labor rules.<\/span><\/p><p><span style=\"font-weight: 400;\">For individual employers without a business and non-profit entities, the main contributions are generally distributed as follows:<\/span><\/p><h2><b>Table 1.
