1. Because it is identical or similar to an existing registered trademark\u00a0<\/b><\/h2>

By far, this is the main reason trademarks are rejected in Colombia.<\/span><\/p>

The SIC does not only evaluate whether two trademarks are identical. It analyzes whether there is a <\/span>risk of confusion or association<\/b> from the perspective of the average consumer, taking into account:<\/span><\/p>

  • Orthographic similarity<\/span>

  • Phonetic similarity<\/span>

    • No prior trademark search was conducted<\/span>

    • Related classes were not analyzed<\/span>

    • Well-known or highly recognized trademarks were ignored<\/span>

      The SIC may deny registration of signs that:<\/span><\/p>

      • Directly describe the product or service<\/span>

        <\/span><\/li>
      • Indicate qualities, characteristics, or functions<\/span>

        <\/span><\/li>
      • Are generic or commonly used in the sector<\/span>

        <\/span><\/li><\/ul>

        Typical examples of rejection include:<\/span><\/p>

        • \u201cArtisan Bread\u201d for a bakery<\/span>

          <\/span><\/li>
        • \u201cDental Clinic\u201d for dental services<\/span>

          <\/span><\/li>
        • \u201cSportswear\u201d for clothing<\/span>

          <\/span><\/li><\/ul>

          Although these names may sound \u201cclear\u201d from a business perspective, they do not function as trademarks from a legal standpoint.<\/span><\/p>

          3. Because it affects third-party rights (Name, Pseudonym, or Reputation)<\/b><\/h2>

          A trademark registration may also be rejected even if there is no identical registered trademark.<\/span><\/p>

          This happens when the applied-for sign:<\/span><\/p>

          • Reproduces or evokes the name or pseudonym of a well-known person<\/span>
