Do I need to declare these earnings? What exactly are my obligations with DIAN?<\/span><\/i><\/p><p><i><span style=\"font-weight: 400;\"><br \/><\/span><\/i><span style=\"font-weight: 400;\">The truth is that the topic may look complex, but it doesn\u2019t have to be. Here we\u2019ll explain, in detail and in plain language, how VAT\u00a0 works and what tax obligations you need to keep in mind for 2025.<\/span><\/p><h1><b>VAT <\/b><i><span style=\"font-weight: 400;\">(IVA Colombia)<\/span><\/i><b> in Rentals: The Basics<\/b><\/h1><p><span style=\"font-weight: 400;\">In Colombia, VAT on rentals depends directly on the type of property and its use.<\/span><\/p><p><span style=\"font-weight: 400;\">By law (Article 476 of the Tax Statute), <\/span><b>residential leases are excluded from VAT<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">On the other hand, leases of commercial-use properties (offices, stores, warehouses, parking lots, etc.) <\/span><b>are subject to VAT at 19%<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">That means:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the property is used for housing \u2192 <\/span><b>no VAT applies<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the property is used for commercial or productive purposes \u2192 <\/span><b>you must charge 19% VAT<\/b><span style=\"font-weight: 400;\">.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">A simple example: renting out a family apartment does not generate VAT, while renting a store for a business does require charging the 19% VAT.<\/span><\/p><h1><b>Special Cases Clarified by DIAN<\/b><\/h1><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A residential condominium as such does not pay income tax, but if it rents its common areas (parking, gym, community hall, etc.), that income <\/span><b>is considered a service subject to VAT<\/b> <i><span style=\"font-weight: 400;\">(IVA Colombia).<\/span><\/i><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If those areas are simply \u201cloaned\u201d or their cost is already included in the administration fee without an extra charge, then no VAT is due.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Also, in 2025 the Council of State determined that a commercial lease used directly for health services (IPS under the Health Benefits Plan) may be considered VAT exempt, overturning previous DIAN interpretations.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\ud83d\udc49 In summary:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Residential rental \u2192 excluded from VAT.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commercial rental \u2192 19% VAT (with exceptions like IPS or when included in administration fees).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">VAT is triggered at the moment the rent is charged (invoice date or payment date).<\/span><\/li><\/ul><h1><b>Tax Differences: Housing vs. Commercial Property<\/b><\/h1><h2><b>Property Use<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rentals exclusively for housing \u2192 VAT exempt.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rentals for commercial use (offices, warehouses, shops, workshops, etc.) \u2192 subject to 19% VAT.<\/span><\/li><\/ul><h2><b>Invoice and VAT Withholding<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For housing rentals, there\u2019s no VAT and no VAT withholding.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For commercial rentals, the landlord must issue an invoice with VAT if responsible; and the tenant (if they are a VAT withholding agent) must withhold VAT on the tax charged.<\/span><\/li><\/ul><h2><b>VAT <\/b><i><span style=\"font-weight: 400;\">(IVA Colombia) <\/span><\/i><b>Responsibility<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A small individual landlord renting residential property may not be responsible for VAT if they fall below income thresholds.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Companies or individuals with high rental income must register as VAT-responsible and charge the corresponding VAT.<\/span><\/li><\/ul><h2><b>Income Tax<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Both types of rental income must be reported in the annual income tax return.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Individuals \u2192 rents go under the \u201ccapital income\u201d section (tax rates from 0\u201339% depending on total income).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Companies \u2192 rents are taxed as ordinary income (~35% corporate tax in 2025).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Important: residential condominiums (propiedad horizontal) are not subject to income tax, but they <\/span><b>must pay VAT<\/b><span style=\"font-weight: 400;\"> when renting out common areas.<\/span><\/li><\/ul><h1><b>Landlord\u2019s Tax Obligations<\/b><\/h1><h2><b>RUT Registration<\/b><\/h2><p><b><br \/><\/b><span style=\"font-weight: 400;\">Every individual or company receiving rental income must register in the RUT (Unique Tax Registry).<\/span><\/p><p><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">Foreigners without tax residency in Colombia are also required to register in the RUT to declare Colombian-source income (such as rental income from property in the country).<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">When registering, you must declare the economic activity as \u201ccapital income earner\u201d and mark the responsibilities (VAT, income tax, withholding) that apply.<\/span><\/p><h2><b>Electronic Invoicing<\/b><\/h2><p><b><br \/><\/b><span style=\"font-weight: 400;\">The obligation to issue invoices depends on the general rules of Article 616-2 of the Tax Statute.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">In practice:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the landlord is a company or operates as a business \u2192 they must almost always issue electronic invoices every month for the rent charged.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Even if the lease is for housing and excluded from VAT \u2192 the invoice is still required for control and deduction purposes.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the landlord is an individual not required to invoice \u2192 the tenant can generate a \u201csupport document\u201d to back the payment and deduct it in their taxes.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">In any case, anyone exceeding invoicing thresholds is obligated to issue invoices, even for leases.<\/span><\/li><\/ul><h2><b>VAT <\/b><i><span style=\"font-weight: 400;\">(IVA Colombia) <\/span><\/i><b>Responsibility<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the lease is commercial, the landlord must calculate and declare VAT on that income.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The landlord only charges VAT if registered as VAT-responsible; otherwise, they don\u2019t.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In 2025, an individual must register for VAT if their annual gross income from taxable activities reaches <\/span><b>3,500 UVT<\/b><span style=\"font-weight: 400;\"> (about COP $174.296 million).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Companies \u2192 always VAT-responsible when leasing taxable properties.<\/span><\/li><\/ul><h2><b>Income Tax Filing<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The landlord must include rental income in their annual tax return.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For individuals \u2192 it is classified as capital income in the relevant section.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For companies \u2192 it is part of ordinary income.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Always keep your contracts, invoices, and bank statements, as DIAN cross-checks this data with third-party reports.<\/span><\/li><\/ul><h1><b>Withholding Taxes<\/b><\/h1><h2><b>Income Tax Withholding\u00a0<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the tenant is a withholding agent (for example, a company or condominium administrator), they must withhold income tax on the payment.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The rate is <\/span><b>3.5%<\/b><span style=\"font-weight: 400;\"> of the total paid, when the payment is equal to or greater than 10 UVT.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the payment is less than 10 UVT, no withholding applies.<\/span><\/li><\/ul><h2><b>VAT <\/b><i><span style=\"font-weight: 400;\">(IVA Colombia) <\/span><\/i><b>Withholding<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Applies only to taxpayers required to withhold.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">When the rent includes VAT (i.e., a taxable lease), the tenant must withhold a portion of that VAT\u2014usually up to 15%\u2014at the time of payment.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For residential leases, VAT does not apply, so there is no VAT withholding.<\/span><\/li><\/ul><h2><b>Payments Abroad<\/b><\/h2><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If rent is paid to a landlord not domiciled in Colombia (a foreigner without a branch in Colombia), a withholding tax of <\/span><b>20%<\/b><span style=\"font-weight: 400;\"> applies to the total payment.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This happens, for example, when a Colombian tenant pays rent directly to a foreign property owner.<\/span><\/li><\/ul><h1><b>Risks of Omissions and Penalties<\/b><\/h1><p><span style=\"font-weight: 400;\">Failing to comply with these obligations can lead to unexpected debts and penalties.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">DIAN can review up to 5 years back and charge omitted taxes (Article 817 ET), plus late interest and fines for late filing or failure to issue invoices.<\/span><\/p><p><span style=\"font-weight: 400;\">Example: in 2024, DIAN detected <\/span><b>1,200 residential complexes<\/b><span style=\"font-weight: 400;\"> that were required to declare VAT on rentals of common areas but didn\u2019t. Result: reclassification processes and collections.<\/span><\/p><p><span style=\"font-weight: 400;\">Common mistakes that lead to penalties include:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Renting a commercial property without issuing invoices (thinking incorrectly that it is exempt).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Accepting cash payments without recording them.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Not updating the RUT after exceeding VAT thresholds.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Not practicing withholdings when required.<\/span><\/li><\/ul><h1><b>Individual vs. Company<\/b><\/h1><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Individuals:<\/b><span style=\"font-weight: 400;\"> Can avoid being VAT-responsible if under the 3,500 UVT income threshold. Still, they must report rental income in their personal income tax return as capital income.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Companies:<\/b><span style=\"font-weight: 400;\"> Always VAT-responsible for taxable leases, must charge 19% VAT, and pay corporate tax (~35%).<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">In short: companies face stricter obligations, while individuals have fewer requirements if under the limits\u2014but still must declare and invoice if they exceed thresholds.<\/span><\/p><h1><b>Rentals by Foreigners<\/b><\/h1><p><span style=\"font-weight: 400;\">Foreign landlords must also consider special rules:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Non-tax residents:<\/b><span style=\"font-weight: 400;\"> taxed only on Colombian-source income (such as rent from Colombian property). They must register in the RUT and file Colombian tax returns, unless the tenant applies final withholding.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tax residents (more than 183 days in Colombia):<\/b><span style=\"font-weight: 400;\"> taxed like Colombians on their worldwide income.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Foreign companies:<\/b><span style=\"font-weight: 400;\"> if they own property in Colombia, it is generally considered a permanent establishment.
