Do you have a company or are you registered in the RUT but haven\u2019t used it in years?<\/span><\/p>

DIAN has just issued a new resolution that could remove you from the system\u2026 without you even requesting it.<\/span><\/p>


<\/span>And no, this is not an exaggeration.<\/span><\/p>

Starting <\/span>January 1st of next year<\/b>, a regulation will come into effect that authorizes the <\/span>automatic cancellation of the RUT<\/b> due to tax inactivity.<\/span><\/p>


<\/span>If you\u2019ve gone more than five years without reporting any activity, you could be removed from the system\u2026 even if you still have pending obligations.<\/span><\/p>

Here\u2019s what this measure means \u2014 in simple terms \u2014 who it applies to, and how to avoid (or reverse) an automatic RUT cancellation.<\/span><\/p>

What is the automatic cancellation of the RUT?<\/b><\/p>

It\u2019s an automatic measure taken by DIAN to clean up its database.<\/span><\/p>

If they detect that a taxpayer has had <\/span>no type of tax activity for five consecutive years<\/b>, they cancel the RUT <\/span>without prior notice<\/b> (other than the corresponding administrative act).<\/span><\/p>

This cancellation does <\/span>not eliminate your tax obligations<\/b> \u2014 it only removes you from the active system, which can cause complications if you want to operate again in the future.<\/span><\/p>

What is considered \u201ctax inactivity\u201d?<\/b><\/h2>

If during the past five years you have:<\/span>
<\/span>\u2013 Not updated your RUT<\/span>
<\/span>\u2013 Not filed any tax returns<\/span>
<\/span>\u2013 Not made any payments to DIAN<\/span>
<\/span>\u2013 Had no third-party information reported about you (e.g., by banks or clients)<\/span>
<\/span>\u2013 Not issued or received electronic invoices<\/span>
<\/span>\u2013 Not requested invoice numbering<\/span>
<\/span>\u2013 No outstanding debts with DIAN<\/span>
<\/span>\u2013 Not been involved in any administrative, judicial, or criminal proceedings with the tax authority<\/span><\/p>

\u2026 then, for tax purposes, you are considered <\/span>completely inactive<\/b>. And DIAN <\/span>can cancel your RUT<\/b> without you requesting it.<\/span><\/p>

Who is NOT subject to RUT cancellation?<\/b><\/h2>

The regulation includes several important exceptions. This automatic cancellation does <\/span>not apply to<\/b>:<\/span>
<\/span>\u2013 Foreign companies with no domicile in Colombia<\/span>
<\/span>\u2013 Foreign individual investors<\/span>
<\/span>\u2013 Community action boards<\/span>
<\/span>\u2013 Indigenous or Afro-Colombian communities<\/span>
<\/span>\u2013 Public entities, superintendencies, the Red Cross, community associations, parent groups, community homes, among others<\/span><\/p>

In other words, if you fall into one of these categories, you may be inactive but still remain registered in the RUT system.<\/span><\/p>

What will the procedure look like?<\/b><\/h2>

DIAN will follow a three-phase process:<\/span><\/p>

I. Identification<\/b><\/h3>

First, they will review all RUT records that haven\u2019t been updated. Then they will verify other causes of inactivity.<\/span><\/p>

II. Issuance and Notification<\/b><\/h3>

Once the case is confirmed, DIAN will issue an administrative act ordering the cancellation and notify the taxpayer, explaining the reasons.<\/span><\/p>

III. Inclusion and Report<\/b><\/h3>

Finally, the cancellation will be recorded in the system and an internal report will be generated with all relevant data.<\/span><\/p>

This entire process is <\/span>internal, fast, and doesn\u2019t require direct involvement<\/b> from the taxpayer.<\/span><\/p>

Can the RUT be reactivated?<\/b><\/h2>

Yes.<\/span>
<\/span>If your RUT was canceled due to inactivity and you want to operate again, you can <\/span>request reactivation at any time<\/b>.<\/span><\/p>

However, you\u2019ll need to catch up on all missed obligations (returns, payments, reports).<\/span>
<\/span>And if DIAN detects that you still have outstanding matters, they may <\/span>reactivate your RUT automatically<\/b> to carry out the corresponding processes.<\/span><\/p>

When does this take effect?<\/b><\/h2>

The resolution comes into force on <\/span>January 1st of next year<\/b>, and it <\/span>repeals<\/b> the previous rule (Resolution 000206 of 2023).<\/span>
<\/span>Any ongoing process under that resolution will continue normally until completed.<\/span><\/p>

So\u2026 does this affect me?<\/b><\/h2>

It depends.<\/span><\/p>

If your RUT has been inactive for five years or more (no returns, no invoicing, no updates)\u2026 yes, you could be removed from the system.<\/span><\/p>

And even if it sounds like something harmless, remember: <\/span>if you have pending obligations, they still apply.<\/b><\/p>

The cancellation of your RUT does not exempt you from fulfilling them.<\/b><\/p>
